Legal Experience

I am an associate with the law firm of McElroy, Meyer, Walker & Condon, P.C. My practice consists of the representation of Indian tribes and their members in a variety of contexts. I have done extensive work for the Navajo Nation in the general stream adjudications of both the Little Colorado River and the Gila River. These adjudications have involved the determination of both the quantity of tribal water rights as well as the priority of those rights. Representation of the Navajo Nation has also included various aspects of the Navajo-Hopi land disputes.

I have worked extensively with the Kaibab Band of Paiute Indians to ensure that the State of Utah and its contractors comply with applicable federal laws in the proposed construction of a water pipeline and the conduct of other activities on and near the Kaibab Reservation. Such federal laws include the National Environmental Policy Act, the Native American Graves Protection and Repatriation Act, the National Historic Preservation Act, the Archaeological Resources Protection Act, and others.

I have been substantially involved in the litigation of Indian gaming issues for the Sault Ste. Marie Tribe of Chippewa Indians in Michigan and the Confederated Tribes of Coos, Lower Umpqua and Siuslaw Indians in Oregon. I also did substantial work for the Sault Tribe on the inland phase of the litigation in United States v. Michigan, which involved the assertion of treaty rights reserved by five Michigan Indian tribes under the Treaty of 1836 in a large portion of Michigan. Additionally, I drafted an administrative code for the Sault Tribe.
